Terms of Service

Effective Date: 1/1/2025

By booking or engaging with Moshin Media (“we,” “us,” or “our”), you (“Client”) agree to the following terms of service:

1. Scope of Services

Moshin Media provides professional real estate media services, including but not limited to:

• Real estate photography
• Videography and video tours
• Drone/aerial imaging
• Virtual tours
• Floor plans
• Social media content creation

All services are customized for real estate marketing and promotional purposes by licensed agents, brokers, and property managers. Specific deliverables and turnaround times will be outlined in each booking confirmation.

2. Client Responsibilities

To ensure smooth service delivery, the Client agrees to:

• Ensure the property is clean and photo-ready by the scheduled time.
• Provide accurate property access instructions.
• Communicate specific requests in advance.
• Obtain necessary permissions for drone operations, if applicable.

Delays caused by the Client or property readiness may incur additional fees or rescheduling.

3. Payment Terms

Payment is due upon delivery of the final media unless otherwise agreed in writing. Accepted payment methods include credit/debit card, ACH transfer, and others as communicated during booking.

• Late payments beyond 14 days may incur a 5% late fee per week.
• Moshin Media reserves the right to withhold delivery or revoke licensing until full payment is received.

4. Rescheduling and Cancellations

• Rescheduling: Must be requested at least 24 hours before the scheduled shoot. Requests made less than 24 hours in advance may incur a rescheduling fee. Weather-related reschedules are accommodated at no charge.
• Cancellations: Less than 24 hours' notice is subject to a $100 cancellation fee or 50% of the shoot cost. No-shows or failure to provide access may also incur charges.

5. Delivery and Revisions

• Edited photography: Delivered within 24-48 hours from the time of the shoot.
• Edited videography: Delivered within 3-7 business days.
• Rush delivery: May be available for an additional fee, with prior arrangement.
• Revisions: Reasonable requests accepted within 3 business days of delivery. Additional edits may incur extra charges.

6. Usage Rights & Licensing

Upon full payment, Moshin Media grants the Client a limited, non-exclusive, non-transferable license to use the delivered media solely for the marketing and promotion of the specific property.

• MLS Use: Licensed media may be used on the MLS, brokerage websites, and real estate platforms while the listing is active.
• Non-MLS Use: Media may also be used for personal portfolios, social media, and email marketing.

Restrictions: Media may not be sold, altered (in a way that misrepresents the property), reused, or transferred to third parties (e.g., builders, stagers, other agents) without prior written consent. Additional licensing fees may apply.

7. Intellectual Property

All media content remains the intellectual property and copyright of Moshin Media. Unauthorized reproduction, editing, or distribution is prohibited and subject to legal enforcement.

8. Limitation of Liability

While Moshin Media strives for quality and timeliness, we are not liable for incidental, indirect, or consequential damages, including delays due to weather, equipment failure, access issues, or third-party platforms.

• Drone services are contingent upon legal and weather conditions and may be canceled for safety or compliance reasons.

9. Dispute Resolution

Disputes shall first be addressed in good faith between both parties. If unresolved, disputes shall be subject to binding arbitration under the rules of the American Arbitration Association. Jurisdiction shall be the state of Florida.

10. Termination

Either party may terminate this agreement with written notice. Services rendered up to termination will be billed accordingly.

11. Amendments & Updates

Moshin Media reserves the right to update these Terms at any time. The most current version will be available on our website or provided upon request.

By booking with Moshin Media, you acknowledge that you have read, understood, and agreed to these Terms of Service.
